Cancellation and reschedule policy

Short, plain, and nothing buried.

I am one person with one table. When an appointment goes unused at short notice it cannot be filled, and that time is simply gone. That is the entire reason any of this exists. It is not designed to catch you out, and if something genuinely goes wrong, talk to me.

1. Cancellation and rescheduling policies

The two that matter.

These are the exact policies you agreed to on the intake form, reproduced in full.

1A. Cancellation Policy

The automated appointment system allows clients to cancel any individual appointment (as long as the appointment is not part of a discounted package) if the appointment time more than 24 hours away from the cancellation time. Appointments within discounted packages are final sale and non-refundable with no exceptions.

1B. Rescheduling Policy

The automated appointment system allows clients to reschedule any appointment if the time of the appointment is more than 24 hours away from the time you make the change. Please plan ahead and allow enough time to reach your appointment on time. If you arrive late, your appointment may be shortened or, if necessary, canceled.

Continuing Care

Pause or cancel by giving at least seven days notice before your next billing date. There is no fee. Nothing rolls over and nothing accrues.

If you are unwell

Please do not come in with something contagious. Tell me and we will move it, and I will not treat that as a late cancellation because you did the decent thing.

Gift certificates

Valid for 12 months from the purchase date, giving the recipient a full year to choose a time that works well. Transferable to someone else, and refundable to the purchaser if the work turns out not to be right for the recipient.

Agreement to terms

These Terms of Use form a legally binding agreement between you and Ida Bella Manual Lymphatic Drainage ("Ida Bella", "we", "us", "our") concerning your access to and use of idabella.net and any related media, collectively the Site. By accessing the Site you confirm that you have read, understood and agreed to be bound by these terms. If you do not agree with them, you must discontinue use immediately.

We may change these terms at any time and will indicate this by updating the date above. Your continued use of the Site after that date means you accept the revised terms.

The Site is not intended for distribution to, or use by, any person in any jurisdiction where such use would be contrary to law or regulation. Those who access it from elsewhere do so on their own initiative and are responsible for compliance with local law.

2. Intellectual property

Unless otherwise indicated, the Site and all source code, functionality, software, design, audio, video, text, photographs and graphics on it, together with the trademarks and logos it contains, are our property or are licensed to us, and are protected by copyright, trademark and other laws. They are provided for your information and personal use only. No part may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, distributed, sold or licensed for any commercial purpose without our express prior written permission.

3. Your representations

By using the Site you represent that: you have the legal capacity to agree to these terms; you are not a minor in the jurisdiction in which you reside; you will not access the Site by automated or non-human means; you will not use the Site for any illegal or unauthorised purpose; and your use will not violate any applicable law.

4. Prohibited activities

You may not use the Site for any purpose other than that for which we make it available, and not in connection with commercial endeavours except those we specifically approve. You agree not to systematically retrieve data to build a database or directory without written permission; to mislead or defraud us or other users; to interfere with security features; to use information from the Site to harass or harm another person; to upload viruses or other harmful material; to engage in automated use, scraping or data mining; to remove copyright notices; to impersonate another person; to interfere with or place undue burden on the Site or its networks; to harass or threaten anyone providing the Site to you; to decompile or reverse engineer the software; or to collect names and email addresses for the purpose of sending unsolicited email.

5. Submissions and feedback

The Site does not invite users to post content. Any questions, comments, suggestions, ideas or feedback you send us are non-confidential and become our property, and we may use and disseminate them for any lawful purpose without acknowledgement or compensation. You warrant that any such submission is original to you or that you have the right to submit it.

6. Site management

We reserve the right, but not the obligation, to monitor the Site for breaches of these terms, to take appropriate legal action against anyone who breaches them or the law, to restrict or disable access at our discretion, and otherwise to manage the Site to protect our rights and to keep it functioning properly.

7. Term and termination

These terms remain in effect while you use the Site. We reserve the right, at our sole discretion and without notice or liability, to deny access to the Site to any person for any reason, including for breach of these terms or of any applicable law.

8. Modifications and interruptions

We may change, modify or remove the contents of the Site at any time without notice, and we are under no obligation to update any information on it. We cannot guarantee the Site will be available at all times, and we will not be liable for any loss or inconvenience caused by downtime or discontinuance.

9. Governing law and disputes

These terms are governed by the laws of the State of California. Any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the state and federal courts located in Alameda County, California, and you consent to the personal jurisdiction of those courts.

10. Corrections

The Site may contain typographical errors, inaccuracies or omissions, including in descriptions, pricing and availability. We reserve the right to correct these and to update information at any time without prior notice.

11. Disclaimer

The Site is provided on an as-is and as-available basis and your use of it is at your sole risk. To the fullest extent permitted by law we disclaim all warranties, express or implied, in connection with the Site and your use of it, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranties about the accuracy or completeness of the Site’s content or the content of any site linked to it.

Nothing on this Site is medical advice, and nothing on it creates a practitioner and client relationship. Manual Lymph Drainage is supportive care. It does not diagnose, treat or cure any disease. Always consult your physician or surgeon regarding your own situation.

12. Limitation of liability

In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising from your use of the Site. Our liability to you for any cause whatsoever, regardless of the form of action, will at all times be limited to the amount paid, if any, by you to us. Some jurisdictions do not allow such limitations, in which case some of the above may not apply to you and you may have additional rights.

13. Indemnification

You agree to defend, indemnify and hold us harmless from any loss, damage, liability, claim or demand, including reasonable legal fees, made by any third party arising out of your use of the Site, your breach of these terms, or your violation of the rights of a third party.

14. Electronic communications

Visiting the Site, sending us emails and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing.

15. Miscellaneous

These terms and any policies posted by us constitute the entire agreement between you and us. Our failure to enforce any provision does not waive it. If any provision is found unlawful or unenforceable, it is severable and does not affect the remaining provisions. No joint venture, partnership, employment or agency relationship is created by these terms.
